County accepts Mexicali ruling

The decision wasn’t a popular one made by a federal judge in San Diego on Thursday, but at least one Imperial County supervisor believes it was the only ruling that could have been made.

“She couldn’t have ruled any other way,” Supervisor Joe Maruca said of Judge Irma Gonzalez’s decision. “The ruling basically said it’s in Mexico and there’s nothing we can do about it.”

The decision ruled against an environmental group that was in a four-year legal battle over two power plants built in Mexicali. Gonzalez ruled that the U.S. Department of Energy, the Bureau of Land Management and power companies InterGen and Sempra Energy took adequate environmental measures to justify DOE’s presidential permits allowing construction of separate cross-border transmission lines to send electricity from Mexico into the U.S.

“We can’t require them to do anything because it’s their country,” Maruca said. “Just like people in Mexico can’t require us to do anything.”

He said the Board of Supervisors was against the decision but said he didn’t think the ruling would be favorable.

Supervisor Larry Grogan said what he was most disappointed with in the ruling is that “the judge refused to acknowledge that if the plant was built in California they would be required to do the offsets.”

While there’s little that can be done with this case, Grogan said it will not keep the Board of Supervisors from fighting for cleaner air quality.

“This does not give us any comfort. I hope it doesn’t set (a precedent),” Grogan said. “Even though they made the ruling they did, it does not mean we will cease our cause with any future developments.”
